These Terms of Service (“Terms”) govern your access to and use of the FairwayCast platform, including the website at www.getfairwaycast.com and all related services (collectively, the “Service”), operated by North Cape Advisors LLC, doing business as FairwayCast (“FairwayCast,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years of age to use FairwayCast. By using the Service, you represent and warrant that you are 18 or older. If we discover that a user is under 18, we will terminate their account immediately.

Your episodes are produced using third-party AI services for script generation and audio synthesis. By using the Service, you acknowledge that:

We reserve the right to remove content and suspend accounts that violate these terms without notice.
You retain ownership of all content you upload to FairwayCast (“Your Content”). We do not claim ownership of your trips, itineraries, files, or generated episodes.
By uploading content, you grant FairwayCast a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely for the purpose of providing the Service to you. This license ends when you delete the content or close your account.
To generate your podcast, your uploaded content and generated scripts are transmitted to third-party AI services for processing. By using the Service, you grant us permission to transmit Your Content to these services on your behalf.
We do not use Your Content to train AI models. We do not sell Your Content to third parties.
FairwayCast operates on a credit-based model with no subscriptions. You purchase episode credits as one-time payments and use them when you're ready. Credits never expire.

One credit = one episode. A full trip (pre-trip hype reel + post-round recap) uses two credits. All payments are processed by our payment provider. Prices are in USD. We reserve the right to change pricing; existing unused credits are unaffected by price changes.
The first 100 waitlist signups are designated as Founding Members and receive a permanent 20% discount on all credit pack purchases. This discount is applied automatically at checkout and does not require a coupon code. The discount is tied to the account and is not transferable.
All credit purchases are final. We do not offer refunds on episode credits. If something went wrong with your generation or you believe there has been an error, contact us and we will do our best to make it right.
The FairwayCast platform, including its design, code, branding, voice personalities, and all non-user content, is owned by North Cape Advisors LLC and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the platform without our written permission.
The FairwayCast name, logo, and “Your trip, your broadcast.” tagline are proprietary to North Cape Advisors LLC.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, FairwayCast disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
To the fullest extent permitted by law, North Cape Advisors LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or reputational harm, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) $50.
You agree to indemnify and hold harmless North Cape Advisors LLC, its members, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any third-party rights.
The Service integrates with third-party providers for authentication, data storage, payment processing, AI generation, hosting, and email delivery. Your use of the Service is also subject to the applicable terms and policies of those providers. We are not responsible for the actions, content, or policies of third-party services.
We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination:
You may terminate your account at any time by contacting us.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Minnesota, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top and notify registered users by email if changes are material. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and North Cape Advisors LLC regarding the Service and supersede any prior agreements.
